For years, Montenegro’s real estate market operated in a regulatory grey zone — agencies with no fixed standards, agents with no formal qualifications, and buyers with little legal protection. That changes in 2026.

Following the publication of comprehensive new bylaws by the Ministry of Economic Development on March 25, 2026, the real estate brokerage sector in Montenegro has been formally regulated for the first time. At LUXE Realty, we’ve reviewed every detail of the new framework so you don’t have to.


A Public Register That Holds Agencies Accountable

One of the most significant changes is the creation of a central, fully electronic, and publicly accessible Register of Intermediaries (Registar posrednika).

Any buyer, seller, or investor can now instantly verify whether an agency is legally registered and operating under state oversight. The register lists an agency’s name, address, tax ID, website, licensed staff, ownership structure — and critically, any fines or bans imposed on them.

Licensed Agents Only — A Professional Exam Is Now Mandatory

Real estate brokerage in Montenegro is now a licensed profession, and LUXE Realty’s team is fully prepared.

Every agent must pass a state exam administered by a commission of the Montenegro Chamber of Commerce, covering four core areas:

  • Legal framework — property law, contract law, inheritance and family law, the cadastre
  • Marketing and management — market analysis, valuation, advertising, negotiation
  • Finance and taxation — mortgage products, insurance, anti-money laundering, VAT
  • Spatial planning and construction — permits, energy efficiency, legalization

Candidates must score at least 75% on the written stage before proceeding to the oral exam. This is a genuine professional standard — and one that LUXE Realty agents are built for.


Offices, Equipment, and Biometric Verification

The new regulations also define where and how agencies must operate. Proper commercial premises are required, a standardized sign must be displayed, and every office must be equipped with client-facing workstations, a computer, printer — and a biometric ID card reader for secure client verification using microchip ID documents.

Transactions Are Now Fully Documented by Law

Every agreement, client detail, property reference, final price, and commission must be logged in writing. Updates are required within eight days of any change, contracts must be retained for a minimum of ten years, and the transaction log permanently.
